"The federal trafficking sex trafficking lawsuit is a very promising and novel legal theory because, at the end of the day, it may be a way to get around a statute of limitations that now might bar a lot of lawsuits against Weinstein", criminal defense attorney Manny Medrano told BuzzFeed News. The news of his departure from the DGA broke hours after another accuser came forward with claims suggesting Weinstein sexually assaulted her in his suite at a hotel in Cannes, France.

A day prior, Herman told NBC's Today he filed the suit under the federal sex trafficking law because he believes the alleged act falls within the statute.

Weinstein also asked Kadian to "walk up and down the room for him" as part of an "audition", the lawsuit said.

Harvey Weinstein was slapped with a civil lawsuit Monday charging him with sex trafficking tied to an alleged assault in Cannes, France.

Once there, the lawsuit said Harvey Weinstein "began massaging Kadian and then gripped her shoulders". Attorneys interviewed by Reuters called the lawsuit's application "innovative" and said they would be watching closely, but expressed mixed views about whether the approach would work in federal court. The disgraced mogul, whose sexual misconduct scandal marked a turning point for Hollywood's casting-couch culture, is now facing a civil suit from a woman in the United Kingdom who claims he sexually harassed her in London. Instead, according to Kadian, Weinstein grabbed her breasts.

"Upon information and belief, the code word among TWC employees "FOH", meant "Friend of Harvey", and referred to a young woman who had participated in sex in exchange for a role or position in an upcoming project", the complaint details.

"TWC employees knew to "take care" of the FOHs". "Mr. Weinstein has further confirmed that there were never any acts of retaliation against any women for refusing his advances".

Neither a representative for Bob Weinstein nor The Weinstein Company immediately respond to ABC News' request for comment.
